Article 1 - Seller identification
This website, Botenor.com, is operated under license by VOY SAS, a company with a share capital of 7,500 euros, whose registered office is located at 28 Cours Albert 1er, 75008 Paris, France, registered with the Paris Trade and Companies Register under number 514 026 996.
Article 2 - General provisions relating to these general terms and conditions of sale (hereinafter the GTC)
1. Purpose of the T&Cs
The T&Cs apply exclusively to the online sale of products marketed by Boténor France SAS via the Boténor.com website (hereinafter referred to as the "Site"), which is open to all.
2. Scope of the T&Cs
The T&Cs exclusively govern online sales contracts for products from Boténor France SAS (hereinafter referred to as the "professional seller") to buyers acting as end consumers (hereinafter referred to as "consumers") and, together with the online order, constitute the contractual documents enforceable against the parties, to the exclusion of all other documents, brochures, catalogs, or photographs of products, which are for indicative purposes only.
An "end consumer" is defined as any natural person acting for purposes outside of any business or professional activity they may practice. If you are not an "end consumer," we ask that you refrain from entering into commercial transactions on the "www.botenor.com" website.
The Customer purchasing on the Site declares that they have the legal capacity to commit to these general terms and conditions of sale.
Every internet user must be at least 18 years old and have the legal capacity or hold parental authorization to place an order on the site. Given the commercial policy described above, Boténor France SAS reserves the right not to fulfill orders from any person who is not an "end consumer" or orders that do not comply with its commercial policy as defined herein.
The T&Cs are exclusively applicable to products delivered to consumers established in France and/or a member country of the European Union.

3. Availability and Enforceability
of the T&Cs
The T&Cs are made directly available to consumers on the seller's website. The T&Cs are enforceable against the consumer, who acknowledges, by ticking a box provided for this purpose, having read and accepted them before placing an order.
Validation of the order by its confirmation constitutes the buyer’s acceptance of the T&Cs in force on the day of the order, the storage and reproduction of which are ensured by the professional seller in accordance with Article 1127-2 of the Civil Code (formerly Article 1369-4 of the Civil Code).
4. Modification of the T&Cs

The professional seller reserves the right to modify its T&Cs at any time.
In the event of a modification of the T&Cs, the applicable T&Cs are those in force on the date of the order, a dated copy of which can be provided to the consumer upon request.
5. Clauses of the T&Cs
The invalidity of a contractual clause does not entail the invalidity of the T&Cs. The temporary or permanent non-application of one or more clauses of the T&Cs by the professional seller shall not constitute a waiver on its part of the other clauses of the T&Cs, which shall continue to have effect.
Article 3 – Products
Boténor France SAS makes every effort to present and describe its items as precisely and accurately as possible. The site offers beauty products for sale.
The products offered for sale and featured in the catalog published on the site are each subject to a description mentioning their essential characteristics within the meaning of Article L. 111-1 of the French Consumer Code. The photographs illustrating the products do not constitute a contractual document.
Some of the products offered on the site may be highly concentrated and very powerful, potentially proving dangerous if used incorrectly, particularly essential oils. Boténor France SAS provides consumers with the information necessary for the proper use of the products. This communicated information does not constitute medical advice and cannot be used for therapeutic purposes.
Boténor France SAS cannot be held liable for any damage caused by improper use of the products sold on its site or by failure to observe the precautions for use.
3. Compliance
The products comply with current regulations relating to personal safety and health, the fairness of commercial transactions, and consumer protection at the time they are placed on the market. The products comply with the requirements of French law in force at the time they are placed on the market.
4. Stocks
The products are offered and delivered within the limits of available stocks.
In the event of the unavailability of the ordered product, the seller shall immediately inform the buyer and may offer them a product of equivalent quality and price or, failing that, a voucher for the amount of the order, which may be used for any future order.
In the event of the buyer's disagreement, the seller shall proceed with the refund of the sums paid within 10 business days.
Apart from the refund of the price of the unavailable product, the seller is not liable for any cancellation indemnity due to stock shortages.
5. Resale of products
The products sold on the site may not be resold or repackaged without the prior written consent of Boténor France SAS.
Article 4 – Price
1. Selling price
Selling prices, in accordance with article L. 112-1 of the French Consumer Code, are indicated for each product in the electronic catalog in euros, inclusive of all taxes, excluding delivery and shipping costs which are mentioned before order validation and billed as an additional charge.
The total amount due from the consumer is indicated on the order confirmation page.
The selling price of the product is the price in effect on the day of the order.
The selling price of the products does not include shipping costs, which are charged in addition to the price.
In the event of a price promotion, the professional seller agrees to apply the promotional price to any order placed during the period in which the promotion is advertised.
2. Modification
The professional seller reserves the right to modify its prices at any time, while guaranteeing the consumer the application of the price in effect on the day of the order.
3. Costs
Additional transport, delivery, or postage costs (to which any other potential costs incurred by the seller must be added), which the customer was able to view before ordering, are set out on the order form.
In the event of an order to a country other than metropolitan France, you are the importer of the product(s) concerned. For all products shipped outside the European Union and French Overseas Territories (DOM-TOM), the price will be calculated exclusive of tax on the invoice. Customs duties, local taxes, import duties, or state taxes may be required. These duties and sums are not the responsibility of the "www.botenor.com" website. They will be at your expense and are your sole responsibility, both in terms of declaration and payment to the competent authorities and bodies in your country. We advise you to check these aspects with your local authorities.
Article 5 - Offer

indication, as long as the products appear in the electronic catalog and within the limit of available stocks.

The acceptance of the offer by the consumer is validated, in accordance with the double-click process, by the confirmation of the
order.
Article 6 – Order
1. Contract conclusion steps
To place an order, the consumer, after filling their virtual basket by indicating the selected products and desired quantities, then clicks on the "Order" button and provides information regarding delivery and payment method.
Before clicking on the "Confirm order" button, the consumer has the opportunity to check the details of their order and its total price and to return to previous pages to correct any errors or potentially modify their order.
By transmitting the order form electronically, you unconditionally accept and undertake to respect, in your dealings with Boténor France SAS, these General Terms and Conditions of Sale. If you disagree with any terms stated in these General Terms and Conditions of Sale, we invite you not to transmit your order form for the purchase of products on the "www.botenor.com" website.
By transmitting your order form, you confirm that you are aware of and accept these General Terms and Conditions of Sale without reservation.
An email acknowledging receipt of the order and its payment is sent by the seller as soon as possible.
2. Order modification
Any modification of an order by the consumer after confirmation is subject to the professional seller's acceptance. The professional seller reserves the right to make modifications to the ordered product linked to technical developments under the conditions provided for in Article R. 212-4 of the Consumer Code.
3. Order validation
The professional seller reserves the right to refuse any order for legitimate reasons, and more specifically if the quantities of products ordered are abnormally high for buyers acting as consumers. The seller may also refuse or delay the processing of an order if they suspect any fraud, such as identity theft or theft of payment methods.
Article 7 - Contract
1. Conclusion
The sales contract is formed at the moment the consumer sends the order confirmation.
2. Archiving and proof
Communications, purchase orders, and invoices are archived on a reliable and durable medium to constitute a faithful and durable copy in accordance with Article 1360 of the Civil Code (formerly Article 1348 of the Civil Code). These communications, purchase orders, and invoices may be produced as proof of the contract.
Article 8 - Payment
1. Due Date
The price is payable in full upon confirmation of the order. Payment is made immediately upon ordering by credit card. The products remain the property of Boténor France SAS until full payment of the price has been received by Boténor France SAS.
2. Payment Security
The site is equipped with an online payment security system allowing the consumer to encrypt the transmission of their bank details via the secure payment platform's electronic payment server. At no time will the consumer's bank details pass through the Boténor France SAS computer system.
Article 9 - Delivery
1. Definition
Delivery is understood as the transfer of physical possession of the goods to the consumer.
2. Shipping time
Under normal conditions, the professional seller will process the order as quickly as possible from Monday to Friday, excluding public holidays. Boténor France SAS undertakes to ship orders within 24 to 48 business hours following order validation, subject to available stock.
3. Delivery time
The prepared order will be handed over to Boténor France SAS's service providers (La Poste or its subsidiaries, Mondial Relay, or others) depending on the chosen delivery method and the destination country.
For delivery in Metropolitan France or Belgium, the delivery time, excluding preparation, is 2 to 3 days after the order is placed.
Orders destined for French Overseas Territories (DOM-TOM) or abroad will also be shipped by our partners. Delivery times vary depending on the region or country of delivery.
In the event of delay or loss, the liability of Boténor France SAS cannot be engaged.
In order to facilitate the delivery of the order by the carrier, the customer agrees to make the necessary efforts to allow the package to be delivered: name visible on the mailbox, transmission of the access code, telephone number, monitoring of emails sent, and responding to telephone calls from the carrier.
4. Delivery delay
In the event of a delivery delay of more than 7 business days, the customer must inform the Boténor France SAS customer service department, which will implement the necessary and appropriate actions.
5. Delivery location
The products are delivered to the address indicated by the customer on the order form. Boténor France SAS delivers to all EU countries, Switzerland, the USA, Canada, South America, Japan, Singapore, South Korea, and Taiwan. Delivery costs depend on the delivery method chosen by the customer and are calculated on the entire order. They will be indicated to the customer at the end of their order before it is confirmed by them. Delivery locations may change at any time and are updated regularly on the site.
6. Product compliance
If the product does not conform to the order, the consumer must send a complaint to the professional seller in order to obtain a replacement for the product or, if applicable, the cancellation of the sale.
7. Transfer of ownership
From the delivery date indicated on the order form, ownership of the product is transferred to the buyer, except in cases where the full payment of the price has not been collected at the time of ordering.
Article 10 - Product Returns and Right of Withdrawal
Boténor France SAS is committed to providing you with high-quality products. However, if you are not satisfied with the product purchased, Boténor France SAS undertakes to exchange it or refund it. Return shipping costs will be at your expense.
You have a period of 14 days from the date of receipt (postmark serves as proof) to return the products to us in their original condition (packaging intact, in saleable condition), accompanied by the invoice issued by Boténor France SAS and any gifts or samples. A refund or credit for the initial amount of your order, excluding shipping costs, will be issued upon receipt of your package, provided it meets the return conditions. Boténor France SAS may defer the refund until the products have been received and verified.
Damaged, opened, or incomplete items will not be accepted and will be returned to you as is, at your expense. Boténor France SAS will also not accept packages sent with postage due. Please note: for hygiene reasons, body and face accessories cannot be returned.

Boténor France SAS reserves the right to refuse a return if it exceeds the legal withdrawal period.
Article 11 - Processing of personal data
Boténor France SAS processes consumer information in accordance with its Privacy Policy.
Article 12 - Dispute Resolution
Boténor France SAS shall not be held liable for damages resulting from the improper use of its products.
In the event of a dispute, you must first contact the company's customer service department via email (info@botenor.com) to attempt to resolve the dispute amicably.
Article 13 – Liability
The products offered comply with current French legislation. It is your responsibility to check with the local authorities in your country regarding the possibility of importing or using the products or services you intend to order. The photographs and texts reproduced, illustrating the products presented, are not contractual. Consequently, the "www.botenor.com" website cannot be held liable in the event of any error in a photograph or text. The "www.botenor.com" website cannot be held liable for failure to perform the concluded contract in the event of stock shortages, product unavailability, force majeure, disruption, flooding, fire, or strikes, particularly regarding postal services and means of transport or communication. The "www.botenor.com" website shall not be held liable for any direct or indirect damages resulting from these risks.
Article 14 - Governing Law
This contract and the General Terms and Conditions governing it are subject to French law.
Article 15 – Intellectual Property
In general, the trademarks and logos appearing on this site, whether registered or not, are the exclusive property of the owner, who grants a license for them to the benefit of Boténor France SAS. All texts, comments, works, illustrations, and images reproduced on the "www.botenor.com" site are reserved under copyright as well as intellectual property rights for the area under the commercial responsibility of Boténor France SAS. As such, in accordance with the provisions of the Intellectual Property Code, only use for private purposes is tolerated, subject to different or more restrictive provisions of the Intellectual Property Code. Any other use constitutes infringement and is punishable under Intellectual Property law, unless prior written authorization is obtained from Boténor France SAS. Any total or partial reproduction of the catalogue of the www.botenor.com site is strictly prohibited.
